Terms of Service

Last updated

Payvern is a calculator. It shows you arithmetic about a purchase you are considering, and it does not tell you what to do. These terms set out what you get, what you pay, and what we are and are not responsible for.

1.Agreement

These terms are an agreement between you and Payvern Inc. (“Payvern”, “we”) covering the Payvern website at payvern.com and the Payvern browser extension. By creating an account or installing the extension you accept them. If you do not accept them, do not use the service.

Our Privacy Policy forms part of this agreement.

2.What Payvern is, and what it is not

Payvern is an educational and calculation tool. It is not financial, tax, legal or investment advice, and it is not a substitute for advice from someone qualified to give it.

Every figure the service shows is arithmetic performed on numbers you supply. It applies the interest rate and payoff period you enter to a price, and reports what that price totals over that period. It assumes a fixed rate, equal monthly payments, no fees, no promotional period, and no further spending on the card. Real credit agreements contain all of those things.

Your card issuer’s actual terms govern what you owe. Where our figure and your statement disagree, your statement is correct. We do not recommend products, rank lenders, tell you whether to buy something, or advise you on how to manage debt. Decisions you make after using Payvern are yours.

3.Your account

You need an account for most of the service, you must be at least 18, and the information you give us must be accurate. You are responsible for keeping your login secure and for activity under your account. Tell us at hello@payvern.com if you believe it has been compromised.

One account per person. Do not share an account or resell access to one.

4.Plans and billing

Free
The manual calculator, up to three saved cards, and five term lookups a day. No payment and no card required.
Core, $5.99 a month
Adds automated highlighting, unlimited saved cards, unlimited term lookups, and the monthly dashboard. Billed from the first day.
Premium, $8.99 a month
Adds the document translator, limited to 30 translations a calendar month, and the debt payoff planner. Monthly subscriptions start with a 7 day free trial.

Annual billing is available at a discount shown on the pricing page. Subscriptions renew automatically at the end of each period until cancelled. Payments are taken by Stripe; we never handle your card details.

If a payment fails we flag the account and Stripe retries over roughly two weeks. Your plan continues during that time. If it is never paid, the subscription ends and the account returns to the free plan.

We may change prices. If we do, we will tell existing subscribers by email at least 30 days before the change applies to them, and you can cancel before it takes effect.

5.Cancelling

You can cancel at any time, in one click, from Settings. There is no confirmation step, no retention offer to click through, and nobody to call. Cancelling is immediate: the subscription ends, unused time in the period you have already paid for is credited back to you, and your account stays open on the free plan with your data intact.

If you upgrade from one paid plan to another, the previous subscription is cancelled automatically and its unused time is credited. You will not be billed for both.

Deleting your account, which is separate and irreversible, also cancels any active subscription. Beyond the credit described above we do not otherwise give refunds, except where the law requires it.

6.Using the service properly

Do not:

  • use the service to break the law, or to infringe anyone else’s rights
  • try to get around plan limits, rate limits, or the tier checks that enforce them
  • access other users’ data, probe our systems for weaknesses without permission, or interfere with the service’s operation
  • scrape the service, resell it, or use it to build a competing product
  • upload documents you have no right to share, or that contain other people’s personal information without their permission
  • automate the service beyond ordinary personal use

If you find a security problem, please tell us at hello@payvern.com before telling anyone else. We will not pursue you for good-faith research reported that way.

7.The extension

The extension asks for broad host access because detecting prices on whatever site you are visiting cannot be limited to a fixed list of domains. It uses that access to read page text in your browser and mark up prices locally. What it does and does not send is described in our Privacy Policy.

It refuses to run on banking, payment, credit bureau, tax and password manager sites, and on any page showing a password field. You can also pause it per site, or uninstall it, at any time.

The extension is distributed through the Chrome Web Store and updates through it. We do not fetch code at runtime.

8.Ownership

The service, its software, its design and its content are owned by Payvern and protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the service under these terms. Nothing else is granted.

Your data is yours. The cards, prices and documents you put into Payvern remain yours, and we claim no ownership of them. You permit us to process them only as far as is needed to run the service for you.

9.Availability

We aim to keep the service running and make no promise that it always will be. We may change, suspend or discontinue features, and we may impose or adjust limits. If we discontinue a paid feature entirely, we will tell subscribers by email and refund the unused portion of what they have paid for it.

10.Disclaimers

The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted or error free, that price detection will identify every price or never misidentify one, or that any figure it produces will match what a lender ultimately charges you. Figures are estimates from the inputs you supply.

11.Limitation of liability

To the fullest extent the law allows, Payvern is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost savings, or decisions made in reliance on a figure the service produced.

Our total liability arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty United States dollars.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is so, the exclusions and limits above apply only as far as that jurisdiction permits, and nothing here removes a right you have that cannot be waived.

12.Ending this agreement

You can stop using the service at any time by cancelling, uninstalling the extension, or deleting your account. We may suspend or close an account that breaches section 6, or where we are required to by law. Where it is reasonable to do so we will warn you first.

Sections 2, 8, 10, 11 and 13 survive the end of this agreement.

13.Governing law

These terms are governed by the laws of the State of Delaware and the federal laws of the United States, without regard to conflict of law rules. Any dispute that cannot be resolved between us will be brought in the state or federal courts located in Delaware, and both of us consent to their jurisdiction.

Nothing here deprives a consumer of the protection of mandatory rules of the country in which they live.

14.Changes

We may update these terms. The date at the top shows when they last changed. If a change is material we will tell account holders by email at least 30 days before it takes effect, and continuing to use the service after that means you accept it. If you do not, cancel and stop using the service.
